Administrative Monetary Penalty System (AMPS)

The Administrative Monetary Penalty System (AMPS) is the Municipality of Central Manitoulin’s resolution process that allows offences to be heard by the Municipality, instead of through the Provincial Offences Act (POA) and the regional court system.

The AMPS system simplifies the process of resolving penalty notices and provides staff with increased discretion to resolve penalty notices, decrease wait times and improve the community member’s experience.

You Have Two Options When You Are Issued a Penalty Notice

Under the new AMPS system, Officers will issue a Penalty Notice to a person that is in violation of a Central Manitoulin by-law. The notice will present two options, pay the ticket, or request a meeting with a Screening Officer to dispute the Penalty Notice.

Pay by Mail:

Make your cheque or money order payable to: Municipality of Central Manitoulin 6020 Hwy 542 Mindemoya, ON. P0P 1S0.

In Person:

During regular business hours of Monday-Friday, 8:30am-4:30pm at 6020 Hwy 542 Mindemoya, ON. Or After hours by cheque made payable to the Municipality of Central Manitoulin placed in the treasury drop box and will be received the next business day.

Please allow sufficient time for your payment to be delivered.
DO NOT SEND CASH IN THE MAIL

To dispute. You have 15 days to do this from when the notice was issued, on or before the date on which the Administrative Penalty is due and payable.

Requesting a Screening Appointment can only be done by the defendant named on the penalty notice. Please take note: All scheduled screenings will take place over Zoom or in person. You will receive an email with instructions upon scheduling your appointment. If you do not attend your scheduled appointment, the penalty notice will be confirmed, and  the defendant named on the penalty notice will be required to pay a fee for failing to attend the appointment. The fee for failure to appear at a scheduled screening review appointment is $25.00 plus tax.

If you are disputing your penalty notice, you must book a Screening Review appointment.

Failure to appear for a scheduled Screening will result in a $25 “Non-Appearance Fee”.

How to Prepare For Your Screening Review

Screening review meetings take place on pre-determined dates. Screening appointments are conducted virtually and occur between 8:30 am and 4:30 pm. Each penalty notice will be afforded a 10 minute appointment and will require and appointment. Penalty Notice Screenings cannot be scheduled for the same day that a penalty notice is received.

Failure to appear for a scheduled Screening will result in the Penalty Notice being affirmed and the addition of administrative fees.

The Municipality of Central Manitoulin does not provide language interpreters, should you require one, you will be responsible for providing your own.

If you attend a Screening Review and are not the registered owner you must complete the authorization to act as an agent form, signed by the registered owner.

You must book a Screening review within 15 days of the date of the Penalty Notice.

You must bring any documents, photos or accessible parking permits with you that may be used as evidence.

Failure to appear for a scheduled Screening will result in a $25 Non-Appearance Fee in accordance with the by-law.

The Screening Officer will review all the documents and evidence with you before making a decision and may:

  1. Cancel the penalty notice, including any administrative fees
  2. Confirm the penalty notice, including any administrative fees
  3. Reduce the amount owed, including any administrative fees
  4. Extend time for payment of the penalty notice, including any administrative fees

The Screening Officer will discuss their decision with you at the end of their review or provide the decision by mail.

Failure to pay the amount set out in the screening decision within 15 days of the due date will be subject to additional administration fees.

If you are not satisfied with the Screening review decision, you can request a hearing review at the conclusion of the screening review.

Preparing For Your Hearing Review

In order to request a hearing review, you must have completed a Screening review as outlined above in the Screening review procedure.

You must submit a Hearing Review Request Form before the due and payable date for the Administrative Penalty listed on the Screening decision. Once you have completed the form the Municipality will confirm the date and time of your hearing review through email or mail.

If you are attending the hearing review and are not the registered owner you must complete the Authorization to Act as an Agent Form, signed by the registered owner.

Officers are not required to be present at the hearing review and may rely on certified evidence as set out in the Administrative Penalty By-law.

Hearing Review appointments may be audio recorded for review purposes only.

Please contact the Municipality should you require an accessible accommodation to attend your screening.

Failure to appear for a scheduled hearing will result in a $50 Non-Appearance Fee in accordance with Schedule “C” of the by-law.

Hearings are to take place over zoom by way of video conference or telephone call. If an individual has accessibility requirements, we request that they notify the Municipality so that arrangements can be made.

Hearing reviews take place at the Municipality of Central Manitoulin Council Chambers where a set up for on line session will take place.

The Municipality of Central Manitoulin does not provide language interpreters, should you require one, you will be responsible for providing your own.

If you fail to appear on the date and time of your hearing review, you will be charged an administration fee of $50.

Please arrive 5 to 10 minutes before you scheduled hearing time. Please be prepared for the hearing review process, including wait times, to take up to two hours.

The hearing will be held before a hearing officer. The Municipality will be asked to present it’s case first, after which you can present any evidence. Witnesses will be required to give evidence under oath or to affirm their evidence.

You can request to reschedule a hearing by providing written notice in person or via email not letter than three business days in advance of the Hearing. Please send emails to ddeforge@centralmanitoulin.ca or provide notice in person to:

If you change your mind and decide to pay the penalty notice up to the day prior to the hearing, as a courtesy please email ddeforge@centralmanitoulin.ca so that your hearing can be cancelled. Please include your penalty notice number, name and address.

The Hearing Officer is not bound by the decision of the Screening Officer. The decision of the Hearing Officer is final and is not appealable.

If you fail to pay the amount set out in the hearing decision within 15 days of the due date, additional administrative fees will be added.

The AMPS system will simplify the process of resolving infraction notices, provide an open, transparent process for infractions and will provide staff with increased discretion to resolve penalty notices, improving the community member’s experience.
